Terms & Conditions

Effective Date: September 10, 2026

These Terms & Conditions (“Terms”) govern your use of the Hendricks Landscape Contractor website and the services provided by Hendricks Landscape Contractor (“Hendricks Landscape,” “we,” “us,” or “our”).

By using our website, submitting a request for services, accepting an estimate or proposal, authorizing work, or engaging Hendricks Landscape to provide services, you agree to these Terms, as applicable.

  1. Website Use

Our website is provided for general information and to allow customers and prospective customers to learn about our services, request estimates, contact us, and interact with Hendricks Landscape.

You agree not to misuse the website, attempt to interfere with its operation or security, or use it for unlawful purposes.

Information provided on our website is intended for general informational purposes and does not constitute an estimate, proposal, guarantee, or agreement to perform services.

  1. Estimate & Service Requests

Submitting an estimate request, contact form, or other inquiry does not create a service agreement or guarantee service availability, pricing, scheduling, or acceptance of a project.

We may contact you using the information you provide to discuss your request, schedule an appointment, prepare an estimate, or otherwise respond to your inquiry.

Hendricks Landscape reserves the right to accept or decline service requests based on location, scope of work, scheduling availability, or other business considerations.

  1. Estimates & Authorization

Estimates and proposals are based on the conditions reasonably observable at the time of inspection and the scope of work described in the estimate.

By accepting an estimate or otherwise authorizing work, the Customer approves the described scope of work and agrees to these Terms.

Services, materials, repairs, or modifications outside the approved scope may require additional authorization and may result in additional charges.

Unless otherwise stated, estimates may be revised if site conditions, material costs, quantities, accessibility, or other circumstances differ from those anticipated when the estimate was prepared.

  1. Scheduling

Work will be scheduled based on crew availability, material availability, weather conditions, property access, and other operational considerations.

Scheduled dates and arrival times are estimates and may change. Hendricks Landscape may reschedule work due to extreme heat, rain, storms, unsafe working conditions, equipment issues, material delays, emergencies, or circumstances beyond our reasonable control.

  1. Property Access

Customers are responsible for providing reasonable and safe access to areas necessary to perform scheduled services.

Gates must be unlocked or necessary access information provided. Pets must be safely secured away from work areas before our crews arrive.

If access is unavailable or conditions prevent our crews from safely completing scheduled work, the service may be rescheduled and additional charges may apply.

  1. General Landscape Maintenance

General landscape maintenance includes only those services included in the Customer’s service agreement or approved scope of work.

Major pruning, tree trimming, plant reductions or removals, irrigation repairs, planting, clean-ups, hauling of excessive debris, and other services outside the normal maintenance scope may require a separate estimate and Customer approval.

Landscape appearance and plant growth naturally vary throughout the year based on season, temperature, irrigation, weather, plant variety, age, and environmental conditions.

  1. Irrigation Systems

Hendricks Landscape will use reasonable care when inspecting, repairing, modifying, or operating irrigation systems. Irrigation systems contain underground and concealed components, and not all deficiencies can be identified during a routine inspection or service visit.

Leaks, damaged lines, failing valves, clogged emitters, wiring problems, deteriorated components, underground damage, and other issues may develop or become apparent after an inspection or repair.

Unless specifically included in an approved scope, an irrigation inspection or repair does not constitute a guarantee against future leaks, component failures, excessive water usage, or changes in a Customer’s water bill.

Customers should promptly notify Hendricks Landscape of unusual water usage, visible leaks, plant stress, or other irrigation concerns.

  1. Underground & Concealed Conditions

Customers are responsible for disclosing known private underground utilities, irrigation components, electrical lines, landscape lighting, drainage systems, pipes, cables, septic components, or other concealed improvements that may affect our work.

Hendricks Landscape is not responsible for damage to private or improperly installed underground items that are not reasonably identifiable or properly disclosed or marked before work begins, except to the extent responsibility cannot legally be excluded.

Unexpected underground or concealed conditions may require additional work, changes in scope, additional charges, or rescheduling.

  1. Plants, Trees & Living Materials

Plants, trees, turf, and other living materials are affected by conditions outside the control of Hendricks Landscape, including extreme temperatures, frost, heat, drought, storms, pests, disease, wildlife, soil conditions, irrigation conditions, and watering practices.

Hendricks Landscape does not guarantee the survival or continued health of plant material unless a written warranty is specifically included in the applicable estimate or proposal.

Plants and natural materials vary in size, shape, color, texture, and appearance. Rock, gravel, soil, mulch, pavers, and other natural or manufactured materials may also vary between batches.

  1. Tree Work

Tree trimming and pruning are performed according to the approved scope with the goal of improving safety, structure, clearance, appearance, and/or overall tree health.

Tree work cannot eliminate all risk of limb or tree failure. Trees may be affected by storms, wind, disease, structural defects, environmental stress, or other conditions that cannot always be identified through ordinary visual inspection.

Unless specifically included in the approved scope, stump grinding, root removal, hauling of pre-existing debris, and repair of existing damage caused by roots are not included in tree trimming or removal services.

  1. Weather & Environmental Conditions

Arizona weather can significantly affect landscape services and plant health. Extreme heat, monsoon storms, wind, freezing temperatures, drought, and other environmental conditions may require work to be delayed, modified, or rescheduled.

Hendricks Landscape is not responsible for damage caused by weather, natural disasters, acts of nature, or other circumstances beyond our reasonable control.

  1. Changes to Approved Work

Customer-requested changes after an estimate has been accepted may result in additional labor, material, equipment, or scheduling charges.

When practical, Hendricks Landscape will obtain Customer approval before completing substantial work outside the original scope. Minor adjustments reasonably necessary to properly complete the approved work may be performed as needed.

  1. Photographs

Hendricks Landscape may take photographs of a property before, during, or after service for estimating, documentation, quality control, training, and internal business purposes.

Any handling of personal information associated with those photographs is subject to our Privacy Policy.

We will not intentionally disclose a Customer’s name, address, or other personally identifying information in publicly used photographs without appropriate permission.

  1. Invoicing & Payment

Customers agree to pay charges for approved services according to the payment terms stated on the applicable invoice, estimate, proposal, or service agreement.

Customers are responsible for reviewing invoices and promptly notifying Hendricks Landscape of questions or discrepancies.

Past-due balances may result in suspension or cancellation of services.

Hendricks Landscape may require deposits, progress payments, or advance payment for certain projects, materials, or services. Applicable payment requirements will be identified in the estimate or proposal.

  1. Online Payments

Hendricks Landscape may provide the ability to make payments electronically through third-party payment processors.

Payment information may be collected and processed directly by third-party payment providers. Hendricks Landscape’s collection and handling of personal information is described in our Privacy Policy. Third-party providers may also maintain their own terms and privacy policies.

Customers are responsible for providing accurate payment and billing information.

  1. Recurring Services

Recurring landscape maintenance will continue according to the agreed service schedule until modified or canceled in accordance with the applicable service agreement.

Services outside the recurring maintenance scope will be billed separately when authorized.

Hendricks Landscape reserves the right to periodically adjust recurring service pricing due to changes in labor, fuel, materials, operating costs, property conditions, service requirements, or other business considerations. Customers will be notified of applicable pricing changes.

  1. Cancellation & Rescheduling

Customers should provide reasonable notice when requesting cancellation or rescheduling of approved work.

Special-order materials, plants, equipment rentals, permit costs, or other expenses incurred specifically for an approved project may be non-refundable or charged to the Customer if the project is canceled after those costs have been incurred.

Recurring service cancellation is subject to any notice requirements contained in the Customer’s service agreement.

  1. Existing Property Conditions

Hendricks Landscape is not responsible for pre-existing damage or deficiencies, including deteriorated irrigation systems, brittle piping, damaged hardscape, unstable trees, improperly installed landscape components, failing electrical systems, poor drainage, existing pest or disease problems, or other conditions that existed before our work began.

If such conditions are discovered during service, we may recommend additional repairs or services.

  1. Email, Telephone & SMS Communications

By providing contact information to Hendricks Landscape, you authorize us to use that information for communications reasonably related to your inquiry, account, estimates, appointments, scheduling, services, invoices, payments, and other customer-service matters.

Where permitted and with any consent required by law, we may also send promotional or marketing communications by email or SMS.

Consent to receive marketing text messages is not a condition of purchasing services from Hendricks Landscape.

Customers may opt out of marketing text messages by replying STOP to a marketing message. Customers may also unsubscribe from marketing emails using the unsubscribe instructions contained in those communications.

Message and data rates may apply to SMS communications.

Opting out of marketing communications does not prevent us from sending necessary transactional or service-related communications when permitted by law.

To the fullest extent permitted by applicable law, Hendricks Landscape will not be responsible for indirect, incidental, special, or consequential damages arising from circumstances outside our reasonable control.
